Understanding Your PIP Insurance After a Car Accident in Florida

What Is PIP Insurance?

 

Personal Injury Protection (PIP) — sometimes called no-fault insurance — is required by Florida law for all registered 
vehicle owners. PIP covers accident-related medical expenses regardless of who was at fault in the collision, up to your policy's coverage limit. Most Florida PIP policies provide up to $10,000 in medical coverage.

Florida's 14-Day Rule — What You Need to Know

Florida Statute 627.736 requires accident victims to seek an initial medical evaluation within 14 days of the accident 
to remain eligible for PIP benefits. Missing this deadline can significantly affect your ability to access the medical 
coverage included in your auto insurance policy.

If you have been in an accident, seek a medical evaluation promptly — even if you feel you were not seriously injured. 
Many traumatic injuries, including soft tissue damage, ligamentous injuries, and concussions, do not produce their 
full symptom picture immediately following a collision.

What PIP Insurance Typically Covers

 

Florida PIP benefits generally include:

  • 80% of reasonable and necessary medical expenses related to the accident

  • 60% of lost wages resulting from your injuries

  • Reimbursement for transportation costs to and from 

  • medical appointments

  • Death benefits

 

Coverage is subject to your individual policy terms and the determination of whether your condition meets the threshold for emergency medical condition (EMC) status under Florida law.

Emergency Medical Condition Determination

Under Florida's PIP statute, the full $10,000 in benefits is available to patients whose condition is determined to 
be an emergency medical condition (EMC) by a qualified physician. Without an EMC determination, benefits may be 
limited to $2,500.
